Deposits are non-refundable! We reserve the right do deny a kitten or sale of a kitten at anytime of the purchase. If we deny the purchase a full refund will be given. Because these are our babies, and not an inanimate object, we reserve the right of a non sale at any time for any reason!
We do not offer any cash refunds if the buyer decides not to follow thru with a sale.

BUYER AGREES TO THE FOLLOWING:
1. Under no circumstances will this cat or kitten be sold, leased or given away, or sold to any pet shop, or research laboratory. If rehoming this cat becomes nessessary, buyer must notify BellagioBengals before rehoming!
2. This cat or kitten will be kept indoors or in a large, secure outside or inside run, and not be allowed to run freely outside.
3. This cat or kitten is being purchased as:
PET Spay/Neutered or TO BE SPAYED/NEUTERED BY NEW OWNER
4. If this cat or kitten is found to be neglected or mistreated, Buyer will surrender said cat or kitten to Seller, unconditionally.
5. THERE WILL BE NO GENETIC GUARANTEE FOR THE ONE YEAR GENETIC DEFECT ON CATS OR KITTENS NOT BRED BY BELLAGIOBENGALS!
6. Genetic guarantee starts from the kittens Date of birth.
HEALTH GUARANTEE, REFUNDS, REPLACEMENTS AND EXPENSES:
____There shall be no refunds of purchase price, shipping charges or other costs. There shall be replacement of the cat/kitten only under the circumstances provided below. No monetary refunds under any circumstances!
___1) This cat or kitten is guaranteed to be in good health at the time of purchase, and the Buyer has three working days to have the cat or kitten examined by a veterinarian for FELV or FIV should the Buyer so desire. Buyer has three days to report any questionable findings by a veterinarian to the Seller. If the kitten or cat is found to be medically deficient with an untreatable or life-threatening problem, it will be replaced with another kitten or cat of equal value. The cat or kitten cannot be returned after the guarantee period has expired and/or if it has been exposed to another cat or allowed outside. The Seller will not replace any cat or kitten that has not received adequate and appropriate care from its new owner. It is the responsibility of the Buyer to provide immediate Veterinary care (at the Buyer’s own expense) to any cat/kitten showing signs of illness or distress and failure to do so will render any guarantee null and void. ALL VET EXPENSES INCURRED AFTER THE CAT OR KITTEN HAS LEFT BELLAGIOBENGALS ARE THoSE OF THE NEW OWNER!
____Bellagio Bengals does not guarantee this kitten is Fip free as there is no 100% test to insure that the vaccine or multicat households themselves do not infact cause the titers of the test to rise. Buyer assumes all vet costs of the 72 office exam required for the contract. Failure to get a 72 hour office exam will render any guarantees for health and genetics from the seller, null and void.
The seller cannot guarantee that this cat/kitten will not end up with
HCM after the one year genetic guarantee or at a later time in its life. This is a cat disease just like a human One. not a cattery disease!
____2) Under no circumstance is a cat or kitten to be destroyed prior to notification by the Buyer to the Seller.. Any cat/kitten for which the Buyer expects replacement must be returned to the Seller (at the Buyer’s expense) so that identity of the cat/kitten can be verified. “Unsound health” shall be defined as any condition which is “life threatening or "incurable” and shall not include curable conditions or infections such as colds, viral, or bacterial infections.
____3) This cat or kitten is guaranteed against congenital defects for one full year. (only if bred by BellagioBengals) From Date of birth (Fip is not included)! Should the kitten or cat die wiithin that time as a direct result of a congenital defect, the cat will be replaced ONLY if a licensed vet performs an appropriate necropsy, and a vet's certificate is provided as proof of cause of death. Bellagio Bengals will replace said kitten/cat with one of equal quality as provided by nature! The vets name, practice, license number and telephone number must accompany the report.
___4) Cats sold as retired breeders are sold with no guarantees as to future health or replacement. The breeder assumes complete care and responsibility of cat the day of possession. No replacements are made of any kind (monetary or otherwise) once cat leaves possession of the breeder. .spay/neuter is done before the retired cat leaves (unless otherwise agreed upon) possession of the seller. Seller assumes no responsibility of the cat once it has left the possession of the sellers home. THE BUYER assumes responsibility of all expenses incurred in relation to the cat/kitten after said cat/kitten leaves the possession of the Seller, as well as any expense incurred at the request of the Buyer before the cat/kitten leaves possession of the Seller. If for any reason the cat/kitten is returned to the Seller, BUYER agrees to pay all expenses, including shipping costs. We do not have a guarantee for Pyo, FIP, FELV, or FIV. We will not replace a kitten if they expire from any of these illness’.
This kitten will receive excessive amounts of tender loving care, will be fed the best possible diet, will receive substantial amounts of entertainment, and will be treated with the utmost respect so that he may realize his full potential.

If the kitten goes into a multi-cat family, it is the responsibility of the buyer to have complete blood profiles done including FIP (corona titer), FIV & FeLuk testing done and sent to seller, before kitten can be returned. The cost of this testing will be at buyer's expense. Kittens are not guaranteed to be hypo allergenic - please test for allergies before getting a kitten if you are unsure.
BREEDER ASSUMES NO LIABILITY FOR VETERINARY COSTS OR OTHER EXPENSES INCURRED BY THE OWNER. BUYER ACKNOWLEDGES THAT BREEDERS LIABILITY CAN NEVER EXCEED WHAT IS EXPRESSED IN THIS GUARANTEE AND AGREEMENT AND IS LIMITED TO PHYSICAL REPLACEMENT OF KITTENS/CATS. This guarantee is null and void should the seller for any reason go out of business and/or stop breeding bengal cats.

This contract is legally binding to all parties involved. It applies only to the buyer and seller in this transaction and is non-transferable to other parties.
FIP CONTRACT
Feline Infectious Peritonitis (FIP) is a deadly virus believed to affect at least 2%-5% of the total cat population or 1 in about 5000 cats.While a lot of research is being done, still very little is known about FIP and the way it is transferred. I feel that it’s imperative that all potential kitten buyers be given the information that is available in as simple terms as possible.
It all starts with a common Coronavirus that almost every cat and kitten is exposed to. That Coronavirus can potentially mutate into the disease called FIP in all it’s disguises. Certain kittens may be immuno-compromised (for many reasons) at the time of exposure and might die of FIP months later. No one can determine why one kitten dies and its littermates go on to live long and happy lives.
FIP is not a cattery problem. It is a feline problem. Some breeders have not yet had a kitten die of FIP and some refuse to admit it when it does happen. Some Veterinarians know less than some breeders. As a cat breeder with a conscience, I must do the research in order to educate kitten buyers and to try to reduce the incidence of this terrible disease. Keeping the numbers of cats down and keeping everything scrupulously clean is advisable for all breeders in order try and avoid FIP mortality. There is “indication” that there is a genetic component. If we are breeding kittens that inherit a weak immune system, then the incidence of FIP mortality will rise. However, “Indication” does not mean proof.
I think that we are hyper-cautious with so many aspects of our cats’ lives and it is reflected in the care that we give them and the careful screening of our potential adopters. Our cats and kittens are not raised in a bubble and they do get exposure to things that hopefully can only increase their immune response when viruses and bacterium are present. I can guarantee that my cats are all negative for FeLV (Feline Leukemia) and FIV (Feline Immunodeficiency Virus) because we test for those viruses. There is no test for FIP. There are DNA tests that are being promoted by laboratories that claim that they can detect conclusive FIP infection. This is not true. The only way to diagnose this disease is, sadly, by post-mortem. Be advised that all cats, and the feline populace of almost every multi-cat household have titers for coronavirus. This means that they have had exposure to coronavirus and that they hopefully have a chance of being able to fight off a potential FIP mutation. An infected kitten most likely contracted the disease before ten weeks of age, when the mother’s immunities have worn off. Also, remember that by the time a kitten is ill, the period of virus shedding has probably stopped. If they were shedding the virus, it was long before you knew they were ill. If a kitten dies of FIP, it does not mean that any of it’s feline housemates will die of it too. In fact, it’s very unlikely. So, your other cats are safe.
There are many ways that FIP strikes a cat. Usually, the symptoms become obvious in a matter of a few days, and unfortunately, it’s hopeless. I am not a Veterinarian and I wouldn’t diagnose FIP myself. There are many symptoms and many forms of this disease in the dry form and the wet form. The purpose of this document is not to frighten but to enlighten. I’m not being an alarmist but a realist. Here are some internet URLs with very informative articles. A simplified way to look at it is that most kittens become exposed to corona virus by the time they are 10 weeks old. The vast majority of these kittens do not go on to develop FIP. However, some few do, as a result of an unpredictable mutation of the virus. This involves complicated factors such as environment, cleanliness, genetic predisposition and stress. The highest incidence of FIP is in cats under the age of 1 year, so the mutation probably takes place in the early months of life.
Bottom Line:
There is no way to predict if it will happen to your kitten. Everyone should be aware that FIP is a remote possibility. And because of the uncertainness behind this disease, we cannot guarantee the kittens from ever getting FIP.

A QUICK NOTE AND UPDATE ON SHIPPING:
I know everyone is excited to get their new babies,
however, it takes time to start planning shipping and getting your kitty
ready to come to you. It does take time AFTER your payment has cleared
our account to start planning. (Crate, absorbent material, Making a Vet visit, clipping nails,
bathing, getting records and papers ready, Making reservations, etc...) All of which need to be done around the busy schedule of life, work and motherhood.
Once your check clears then we will start making arrangements for
the health certificate and shipping arrangements.
Usually within 7-14 days your kitten will be shipped and in your home.
We assure you that we will work quickly to get your kitten to you, it is a slow process sometimes!
We have moved to an area which is a little slow pace, and we like it that way!
Our vet is in the country and he is on call with cattle, horses, pigs, and other livestock,
so a quick trip to the vet is not always feasible.
So we ask you to PLEASE be patient with us. If you are not willing to
be patient, then we please ask you not to inquire about our kittens!
